Please read these Terms of Service carefully before accessing or using the Lumen Resources website (the “Site”) or any educational resources, materials, downloads, features or services made available through it (collectively, the “Services”).

These Terms of Service (“Terms”) set out the terms and conditions governing access to and use of the Site and Services provided by Lumen Resources (“Lumen”, “we”, “us” or “our”).

By purchasing a subscription, creating an account, accessing the Site or using any of the Services, you agree to be bound by these Terms.

These Terms should be read together with our Privacy Policy and any other policies or terms referred to within them.

1. Acceptance of Terms

By purchasing a subscription, creating or using an account, accessing Lumen resources, downloading materials or otherwise using the Site or Services, you confirm that you have read, understood and agree to be bound by these Terms.

Where a subscription is purchased on behalf of a school or other educational establishment, the person purchasing or activating the subscription confirms that they have authority to do so on behalf of that organisation.

The subscribing school or organisation, and those accessing the Services under its subscription, must comply with these Terms.

Access to Lumen is provided subject to the subscription or licence purchased. Purchasing a subscription gives the subscribing school or organisation permission to access and use Lumen resources in accordance with these Terms. It does not transfer ownership of Lumen Content or intellectual property.

We may update these Terms from time to time. Where changes are material, we will take reasonable steps to make subscribers aware of the updated Terms.

2. Eligibility

The Services are intended primarily for use by schools, educational establishments and authorised members of their staff.

You must be at least 18 years of age to purchase a subscription or enter into an agreement with Lumen Resources.

Where you purchase or register for a subscription on behalf of a school or other organisation, you confirm that you have authority to do so on behalf of that organisation.

Pupils may use or view Lumen resources when those resources are provided, displayed or delivered by an authorised member of staff as part of teaching, learning, prayer, worship, assemblies or other appropriate educational activities.

Pupils are not required or permitted to purchase subscriptions or independently register for subscriber accounts.

We reserve the right to refuse, suspend or terminate access to the Services where we reasonably believe that these Terms have been breached, a subscription is being misused, or use of the Services is unlawful.

3. Registration and Account Security

Access to some or all of the Services may require an account associated with an active Lumen subscription.

When registering or purchasing a subscription, you must provide information that is accurate, complete and up to date.

You are responsible for keeping your account and login details secure and for taking reasonable steps to prevent unauthorised access to the Services.

Account or login details must not be shared with individuals who are not authorised to access Lumen under the relevant subscription.

In particular, account details must not be shared with another school or organisation for the purpose of allowing it to access Lumen without its own appropriate subscription.

If you become aware of, or reasonably suspect, unauthorised access to your account, you should notify Lumen Resources as soon as possible.

We reserve the right to suspend or restrict an account where we reasonably believe that it has been compromised, shared outside the scope of the subscription or otherwise used in breach of these Terms.

4. Personal Data and Privacy

We process personal data in accordance with our Privacy Policy and applicable data protection law.

When you create an account, purchase a subscription, contact us or otherwise use the Services, we may process information necessary to provide and administer the Services, manage subscriptions, communicate with users and meet our legal obligations.

Lumen resources are designed for use by teachers and schools and do not require pupils to create individual subscriber accounts.

5. Lumen Content

For the purposes of these Terms, “Lumen Content” means educational resources and other materials made available through Lumen Resources, including but not limited to:

  • lesson materials;

  • presentations;

  • worksheets;

  • teacher guidance and notes;

  • written educational content;

  • Scripture and Bible-based resources;

  • saints resources;

  • prayer and reflection materials;

  • assemblies;

  • illustrations and graphics;

  • photographs;

  • audio and video materials;

  • downloadable files; and

  • other educational or digital materials made available through the Services.

Lumen Content may be revised, updated, replaced or withdrawn from time to time.

We take reasonable care in preparing Lumen Content and aim to ensure that it is accurate and appropriate at the time of publication. Teachers and schools remain responsible for exercising their professional judgement when choosing and using resources with pupils.

6. Intellectual Property and Copyright

A. Ownership

Unless otherwise stated, all original Lumen Content, together with the design, branding and organisation of the Site, is owned by Lumen Resources or is used by Lumen Resources with appropriate permission or licence.

Lumen Content is protected by copyright, trade mark and other applicable intellectual property laws.

Purchasing a subscription, downloading a resource or otherwise accessing the Services does not transfer ownership of Lumen Content to the subscriber, school, staff member or pupil.

All intellectual property rights in original Lumen Content remain with Lumen Resources.

Where Lumen Content incorporates material owned by a third party, ownership of that material remains with the relevant copyright owner and its use may be subject to additional licence conditions.

B. School Licence

Subject to these Terms and payment of the applicable subscription fee, Lumen grants the subscribing school or educational establishment a limited, non-exclusive and non-transferable licence to access and use Lumen Content for its own internal educational purposes.

Authorised staff within the subscribing school may:

  • access and display Lumen Content for teaching, learning, prayer, worship, assemblies and other appropriate educational activities;

  • download Lumen resources that are made available for download;

  • print and make reasonable copies for staff and pupils within the subscribing school;

  • upload resources to secure school-controlled digital learning environments where access is restricted to staff and pupils of the subscribing school; and

  • adapt resources where reasonably necessary to meet the educational needs of pupils within the subscribing school.

The licence applies only to the subscribing school or organisation and does not extend to other schools, organisations or individuals.

C. Restrictions

Unless prior written permission has been obtained from Lumen Resources, users must not:

  • sell, resell, rent, sublicense or commercially exploit Lumen Content;

  • distribute or share Lumen Content with another school or organisation not covered by the relevant subscription;

  • upload Lumen Content to publicly accessible websites, shared drives, resource-sharing platforms or other public online services;

  • upload complete Lumen resources publicly on social-media platforms;

  • make Lumen Content available through a digital system accessible to individuals outside the subscribing school;

  • reproduce Lumen Content for publication or distribution outside the subscribing school;

  • systematically copy or download substantial parts of the Lumen library for redistribution;

  • remove or deliberately obscure Lumen branding, copyright notices or ownership information where these appear;

  • present Lumen Content, or a substantial adaptation of it, as their own original work; or

  • use Lumen Content to create resources or products intended for sale, commercial distribution or publication.

Nothing in these Terms prevents a subscribing school from displaying or providing relevant Lumen Content to its own pupils as part of normal educational use.

Copyright protection exists automatically for qualifying original works in the UK; a copyright notice does not have to appear on every individual resource for that protection to exist.

7. Acceptable Use

You agree to use the Site and Services only for lawful purposes and in accordance with these Terms.

You must not:

  • provide subscriber login details to another school or organisation;

  • allow individuals not authorised under your subscription to access subscriber-only Lumen Content;

  • use another subscriber's account without permission;

  • attempt to gain unauthorised access to another account or restricted area of the Site;

  • circumvent restrictions placed on access to the Services;

  • use a subscription purchased for one school to provide access to another school or organisation;

  • knowingly introduce viruses, malware or harmful software;

  • interfere with the proper operation or security of the Site;

  • use automated systems, bots or scraping tools to systematically copy, download or extract Lumen Content; or

  • use the Site or Services for fraudulent or unlawful purposes.

Where we reasonably believe that these Terms have been breached, we may take appropriate action, including restricting or suspending access or terminating an account or subscription.

8. Third-Party Services and Links

The Site may contain links to websites, services or resources provided by third parties.

These links may be provided for convenience, reference or educational purposes. Their inclusion does not necessarily mean that Lumen endorses or controls those third-party websites, organisations or services.

When you access a third-party service, its own terms, privacy policy and other conditions may apply.

To the extent permitted by law, Lumen Resources is not responsible for the content, availability, security or practices of websites or services that we do not control.

Lumen may also rely on third-party providers for website hosting, subscription management, payment processing, email communications and other technical services.

9. Subscriptions and Pricing

Access to some or all Lumen Content requires a paid subscription.

The subscription options, prices, subscription period and relevant features will be displayed on the Site or otherwise communicated before purchase.

Unless otherwise stated, subscription fees are payable in advance for the relevant subscription period.

The price presented at the time of purchase is the price payable for that subscription period.

10. School Subscription Categories

Lumen may offer different subscription categories according to factors such as school size or pupil roll.

The subscribing school is responsible for selecting the subscription category that accurately reflects its circumstances.

Where requested, the subscriber must provide accurate information relating to the relevant subscription category.

Where we reasonably believe that an incorrect category has been selected, we may contact the school and require the subscription to be changed to the correct category.

Where necessary, subscriber access may be restricted until the matter has been resolved.

11. Payments

Payments may be processed on our behalf by a third-party payment provider.

Users are responsible for providing accurate and current payment and billing information.

Where a payment is declined, reversed or remains outstanding, we may contact the subscriber to resolve the issue.

Access to subscriber-only Services may be suspended where payment remains outstanding.

Use of a third-party payment provider may also be subject to that provider's own terms and privacy policy.

12. Subscription Period and Renewal

A subscription provides access to the relevant Services for the subscription period stated at purchase.

Access will normally begin when the subscription is activated unless another start date has been agreed.

Where subscriptions automatically renew, this will be made clear before purchase.

Where a subscriber has agreed to automatic renewal, the subscription will renew in accordance with the renewal terms presented at purchase unless cancelled before the applicable renewal date.

Where automatic renewal does not apply, a new subscription will need to be purchased or arranged to continue subscriber access after the existing subscription expires.

We may change subscription prices for future subscription periods. Any change will not retrospectively alter the price of a period that has already been paid for.

Where a change affects an upcoming renewal, appropriate notice will be provided where required.

13. Cancellation and Refunds

Where automatic renewal applies, subscribers may cancel future renewal using the method available through their account or by contacting Lumen Resources.

Cancelling renewal does not normally end access immediately. The subscription will generally remain active until the end of the period already paid for.

Except where required by law or expressly stated otherwise, cancellation during an existing subscription period does not automatically entitle the subscriber to a full or partial refund.

Any specific refund, cancellation or promotional terms provided at the point of purchase will also apply.

Contractual terms should be clear and fair, and terms that unfairly disadvantage customers may not be enforceable.

14. Resources Following Subscription Expiry

When a subscription expires, access to subscriber-only areas of the Site, newly published subscriber resources, updates and further downloads will end unless the subscription is renewed.

Resources lawfully downloaded by a school while it held an active subscription may continue to be retained and used internally by that school for educational purposes.

The copyright and distribution restrictions contained in these Terms continue to apply after the subscription expires.

Previously downloaded Lumen Content must not be:

  • shared with another school or organisation;

  • resold or commercially exploited;

  • uploaded to public websites or resource-sharing platforms;

  • represented as the school's own original work; or

  • used to create products intended for sale or external distribution.

15. Educational Content and Professional Responsibility

Lumen Resources aims to provide high-quality materials supporting Catholic education, religious education and faith formation.

The resources are intended to support, rather than replace, the professional judgement of teachers, school leaders, clergy and other relevant professionals.

Schools and teachers remain responsible for determining whether a resource is suitable for:

  • the pupils using it;

  • the school's curriculum;

  • local policies or requirements;

  • the relevant diocese or episcopal conference; and

  • the educational or pastoral context in which it is used.

16. Catholic Teaching and Accuracy

We take reasonable care to prepare Lumen resources accurately and faithfully.

Lumen Resources is intended to support Catholic religious education and faith formation. However, schools remain responsible for ensuring that resources are used consistently with any requirements or guidance issued by their school, diocese, episcopal conference, education authority or curriculum body.

Educational, curricular and other information may change over time.

We may update, correct, replace or withdraw resources where appropriate.

If we become aware of a significant error in a resource, we will take reasonable steps to correct it.

17. Availability of the Services

We aim to keep Lumen available and operating reliably but cannot guarantee uninterrupted access at all times.

The Services may occasionally be unavailable because of:

  • maintenance;

  • updates;

  • technical difficulties;

  • internet or hosting failures;

  • third-party provider outages; or

  • circumstances outside our reasonable control.

Where reasonably possible, we will seek to restore access promptly.

We do not guarantee that every individual resource or feature will remain available indefinitely.

18. Technical Requirements

Users are responsible for having suitable devices, internet access, software and systems necessary to access and use Lumen.

We cannot guarantee that every resource will operate identically on every device, browser, interactive display, application or school IT system.

19. Suspension and Termination

We may suspend or terminate subscriber access where:

  • payment remains outstanding;

  • an account is being used in breach of these Terms;

  • subscriber access has been deliberately shared outside the licensed school;

  • Lumen Content has been unlawfully distributed, sold or published;

  • an incorrect subscription category has deliberately been selected;

  • there has been serious or repeated misuse of the Services; or

  • suspension or termination is reasonably necessary to protect the Site, our rights or comply with legal requirements.

Where appropriate and reasonably practicable, we will contact the subscriber before terminating access and provide an opportunity to resolve the issue.

Termination or expiry does not affect Lumen's ownership of its intellectual property.

Copyright, intellectual-property and unauthorised-distribution provisions continue to apply after termination.

20. Limitation of Liability

Nothing in these Terms excludes or restricts liability where doing so would be unlawful.

To the extent permitted by applicable law, Lumen Resources will not be responsible for indirect or consequential losses resulting from use of, or inability to use, the Services.

We will not be responsible for losses arising solely from circumstances outside our reasonable control, including internet failures, third-party service interruptions, school IT systems or incompatible equipment.

Schools and authorised users remain responsible for professional, educational and pastoral decisions made when using Lumen Content.

Nothing in these Terms affects rights or remedies that cannot lawfully be excluded or restricted.

21. Changes to the Services

We may develop or change Lumen from time to time, including by:

  • adding new resources or services;

  • updating existing resources;

  • replacing outdated resources;

  • reorganising the Site;

  • changing the way resources are delivered; or

  • withdrawing particular resources or features.

Where a change would materially affect a paid subscription, we will take reasonable steps to communicate that change where appropriate.

22. Changes to These Terms

We may update these Terms to reflect changes to Lumen, our business practices, applicable law or other relevant circumstances.

The latest version will be published on the Site with the date on which it was last updated.

Where a change is material, we will take reasonable steps to notify affected subscribers.

23. Governing Law and Jurisdiction

These Terms and any dispute or claim arising from them shall be governed by the laws of Scotland, unless applicable law requires otherwise.

Subject to any mandatory legal rights that apply, the courts of Scotland shall have jurisdiction in relation to disputes arising from these Terms or use of the Services.

24. General

If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid or unenforceable, the remaining provisions will continue in effect.

A failure or delay by Lumen Resources to exercise a right under these Terms does not mean that the right has been waived.

A subscriber may not transfer its Lumen subscription or licence to another school or organisation without prior written permission from Lumen Resources.

These Terms, together with the Privacy Policy and any additional terms expressly provided at the point of purchase, constitute the terms governing access to and use of the Services.
